Wells Fargo fined $250 million for 'unsafe' home lending management


Wells Fargo will pay $250 million after regulators accused the bank of failing to properly oversee home mortgages, which are handled by a Des Moines-based company division.

Bank executives and the U.S. Office of the Comptroller of the Currency announced a consent order Thursday requiring Wells Fargo employees to improve their decision-making when evaluating whether borrowers qualify for relief on loan payments. 

"This is unacceptable," Acting Comptroller of the Currency Michael Hsu said in a statement. ".  The OCC will continue to use all the tools at our disposal, including business restrictions, to ensure that national banks address problems in a timely manner, treat customers fairly, and operate in a safe and sound manner.”

In addition to paying the fine, Wells Fargo executives agreed to temporarily stop servicing other lenders' mortgages, an arrangement in which the bank receives fees for handling other banks' customer payments. At the other end of such arrangements, Wells Fargo also will stop giving other lenders the fee-generating servicing responsibilities for some mortgages in exchange for an up-front payment.

Wells Fargo & Co. issues more mortgages than any other bank in the country. Ranked as metro Des Moines' No. 1 private employer, it has about 13,000 workers in central Iowa, a spokesperson told the Des Moines Register earlier this year.

According to an OCC cease-and-desist order, a committee at the bank needs to write policies to help how to get bank statement wells fargo app more accurately evaluate whether borrowers qualify for mortgage relief.

That action was tied to the bank's fake accounts scandal, in which thousands of employees opened new accounts in unwitting customers' names to increase commissions.

"Our work to build the right foundation for a company of our size and complexity will not follow a straight line," Scharf said in a statement. "We are managing multiple issues concurrently, and progress will come alongside setbacks. That said, we believe we’re making significant progress."

Wells Fargo most recently reported a $6 billion profit for the quarter ending June 30. That included $2.07 billion in revenue from its home lending division, a 40% increase over the same period a year earlier.

In March, Tammi Wilson was checking on her family's mortgage online at Wells Fargo when she saw a link to information about COVID-19 on the bank's website. After clicking through, she provided contact information so she could receive materials on programs at the bank. Days later, she said, she returned to the payment page to transmit what she and her husband, David, owed on their loan. A message popped up saying she had no active accounts and couldn't make the payment.

Wilson later learned what had happened. Without her knowledge, the bank had put her into a program that suspended payments on her federally backed loan. Known as forbearance, it is a CARES Act program that aims to help borrowers who are having trouble making their payments because they've been hurt by COVID-19.

Because she hadn't asked for forbearance, Wilson continued to make all her family's mortgage payments. She has also spent hours on the phone with Wells Fargo to get out of the program. Finally, on July 1, the bank sent her a letter confirming her request to "opt out" of the program she said she never opted into.

Still, Wilson's credit report, dated July 18 and reviewed by NBC News, shows that the family mortgage is "in forbearance" and that the April and May payments weren't credited to the account, even though the Wilsons submitted them.

While in forbearance, Wilson and her husband almost certainly can't refinance their mortgage, because most banks won't underwrite new loans for borrowers whose mortgage payments are suspended. As long as the forbearance notation remains in their credit report, the Wilsons can't take advantage of rock-bottom interest rates and are stuck at Wells Fargo.

"I click this button and next thing I know, I'm getting a thing that says I'm deferred and I can't reverse something I didn't even want," Wilson said in an interview. "If you're going to help people, there is a super simple first step — just ask, 'Do you need our help?'"

Under the CARES Act, which provides help on loans backed by the government-sponsored companies Fannie Mae, Freddie Mac, Ginnie Mae and others, borrowers harmed by COVID-19 can ask to suspend their mortgage payments for up to a year. The amounts they owe during the period are either tacked onto the ends of the loans or paid off before. No additional fees, interest or penalties can accrue on the loans while they are in forbearance.

Last week, NBC News reported on borrowers in Chapter 13 bankruptcy whom Wells Fargo had placed, without their permission, in forbearance programs. But the bank's practice extends beyond such specialized borrowers, some of whom contacted NBC News.

Wells Fargo is one of the largest U.S. banks that underwrites and services home loans. Borrowers in at least 14 states have told courts, lawyers or NBC News that they have been forced into forbearance plans by Wells Fargo: Alabama, Arizona, California, Florida, Kansas, Louisiana, Michigan, Missouri, New Hampshire, New Jersey, New York, North Carolina, Texas and Virginia.

"In the spirit of providing assistance, we may have misinterpreted customers' intentions in a small number of cases," Mary Eshet, a spokeswoman for Wells Fargo, said in a statement to NBC News. "In those limited cases, we are working directly with customers to ensure they are receiving the assistance they need and make any corrections to their accounts that may be required."

The statement also said: "As soon as COVID began to impact our customers, Wells Fargo was intently focused on assisting any customers who needed help, and we have deferred 2.5 million payments for consumer and small business customers as a result. During the early stages of the crisis — even before the CARES act was passed — we provided relief to mortgage and home equity customers who we learned were impacted by COVID over the phone, through our secure email channel, or through other means. Customers placed in forbearance received notices of that action through multiple channels, and we removed them from forbearance upon their request."

It couldn't be determined whether Wells might be benefiting from volunteering borrowers for forbearance, and the bank's statement didn't answer that question. By retaining borrowers who might otherwise refinance their mortgages with other institutions, Wells Fargo continues to have their business. Wilson, for example, said she would like to move her mortgage to a different bank but fears she won't be able to given her credit report.

This isn't the first time Wells Fargo has signed up customers for services they didn't request. The bank has come under pressure in recent years for opening unrequested bank and credit card accounts for clients; it forced others to buy auto insurance they didn't need and, in some cases, weren't told about.

Sen. Sherrod Brown of Ohio, the ranking Democrat on the Banking Committee, called out the bank.

"Once again it seems that Wells Fargo's sloppy service and shoddy management are hurting consumers," he said in a statement. "Wells Fargo should immediately address each of these complaints and make changes to ensure that no borrower finds themselves worse off from actions that their servicer takes without their consent or notice."

Eileen Roth, a math teacher in New Hartford, New York, is another Wells Fargo customer who was placed in an unwanted forbearance. Like Wilson, Roth's forbearance shows up on her credit report.

She said that because her mortgage payments are automatically deducted from her bank account, she doesn't normally worry about them. She hadn't asked the bank to suspend her payments, but on June 22 she got a phone call from Wells Fargo. The representative said that because she had been in forbearance since March 20, her mortgage payments had stopped being deducted.

Roth said she was shocked and angry and told the bank that she wasn't interested in the program. The Wells Fargo employee insisted that Roth "mistakenly" applied for it on the bank's website, Roth said; it wasn't her mistake, she added.

"I was never asked to be put into that program," Roth said. "I started getting anxious that now, by no fault of my own, I have this on my record."

To protect troubled borrowers from harm to their credit reports during the pandemic, the CARES Act states that if a bank makes an santander one time payment to a consumer — such as suspending mortgage payments — it can't report a change in the borrower's status, such as no longer being current on the loan. In late March, Gerald Forsburg of Mount Jackson, Virginia, also visited the Wells Fargo website and quickly found himself in a forbearance plan. The plan wrecked the loan modification he had secured from Wells Fargo days earlier, which had reduced his monthly payments by over $200.

Forsburg said he went on the Wells Fargo website to check on the status of his loan modification. "This button shows up — if you've been affected by COVID, click here. I don't remember clicking anything else," he said.

On May 1, when he went online to make his first lower payment under the loan modification, the system didn't let him pay. His account showed only the higher amounts owed under his previous loan. Then, in June, Wells Fargo sent him a letter telling him the suspension of his mortgage payment had been extended for three more months.

"When I clicked on the original button, I didn't know that I was getting a forbearance," Forsburg said. "There was no description of legal ramifications due to clicking on that button. It's very scary for me and my family. We don't want to lose our house."

Thad Bartholow, a how to get bank statement wells fargo app at Kellett & Bartholow, represents Forsburg in a lawsuit against Wells Fargo. He said: "Forbearance is extremely powerful medicine. It's like putting someone on opioids for a minor headache after they told you they didn't want or need anything at all."

According to the Consumer Financial Protection Bureau, before a bank servicing a loan can grant forbearance, it is supposed to receive an attestation of a COVID-19-related financial hardship from the borrower. But none of the Wells Fargo borrowers who shared their stories with NBC News had supplied such documents to the bank.

Eshet, the Wells Fargo spokeswoman, didn't say why the bank doesn't require an attestation from borrowers.

Wells Fargo fined $250 million for 'unsafe' home lending management


Wells Fargo will pay $250 million after regulators accused the bank of failing to properly oversee home mortgages, which are handled by a Des Moines-based company division.

Bank executives and the U.S. Office of the Comptroller of the Currency announced a consent order Thursday requiring Wells Fargo employees to improve their decision-making when evaluating whether borrowers qualify for relief on loan payments. 

"This is unacceptable," Acting Comptroller of the Currency Michael Hsu said in a statement. "...  The OCC will continue to use all the tools at our disposal, including business restrictions, to ensure that national banks address problems in a timely manner, treat customers fairly, and operate in a safe and sound manner.”

In addition to paying the fine, Wells Fargo executives agreed to temporarily stop servicing other lenders' mortgages, an arrangement in which the bank receives fees for handling other banks' customer payments. At the other end of such arrangements, Wells Fargo also will stop giving other lenders the fee-generating servicing responsibilities for some mortgages in exchange for an up-front payment.

Wells Fargo & Co. issues more mortgages than any other bank in the country. Ranked as metro Des Moines' No. 1 private employer, it has about 13,000 workers in central Iowa, a spokesperson told the Des Moines Register earlier this year.

According to an OCC cease-and-desist order, a committee at the bank needs to write policies to help employees more accurately evaluate whether borrowers qualify for mortgage relief.

The OCC also ordered the company to assess employees' decision-making every three months, create a new plan for how to handle customer complaints, properly document all decisions and maintain enough workers to handle borrowers' requests for relief.

“Building an appropriate risk and control infrastructure has been and remains Wells Fargo’s top priority,” Wells Fargo CEO Charlie Scharf said in a statement Thursday. “The OCC’s actions today point to work we must continue to do to address significant, longstanding deficiencies.”

Guy Cecala, publisher of Inside Mortgage Finance, said the regulators' penalty against Wells Fargo ties back to the Great Recession, when subprime mortgages caused of wave of foreclosures.

In the wake of the economic collapse, lawmakers and regulators required banks to offer special debt relief to certain borrowers who may have been victims of predatory lending. For example, a borrower whose mortgage rate doubled to 12% may not have enough income to keep up with monthly payments.

As that borrower fell behind, Cecala said, regulators required lenders to offer help rather than immediately foreclose. The banks may have needed to lower the borrower's interest rate or provide more time to catch up.

Cecala said some lenders have struggled to determine which customers qualify for relief. The OCC and the Consumer Financial Protection Bureau also fined Wells Fargo a combined $1 billion three years ago after the bank improperly charged customers fees to "lock" a mortgage interest rate for a certain period of time.

"Despite a lot of effort, Wells Fargo hasn't fixed everything that needs to be fixed," Cecala said Friday.

In its statement Thursday, Wells Fargo also announced that its 2016 consent order from  the Consumer Financial Protection Bureau expired this week. That action was tied to the bank's fake accounts scandal, in which thousands of employees opened new accounts in unwitting customers' names to increase commissions.

"Our work to build the right foundation for a company of our size and complexity will not follow a straight line," Scharf said in a statement. "We are managing multiple issues concurrently, and progress will come alongside setbacks. That said, we believe we’re making significant progress."

Wells Fargo most recently reported a $6 billion profit for the quarter ending June 30. That included $2.07 billion in revenue from its home lending division, a 40% increase over the same period a year earlier.

More Wells Fargo customers say the bank decided to pause their mortgage payments without asking

In March, Tammi Wilson was checking on her family's mortgage online at Wells Fargo when she saw a link to information about COVID-19 on the bank's website. After clicking through, she provided contact information so she could receive materials on programs at the bank. Days later, she said, she returned to the payment page to transmit what she and her husband, David, owed on their loan. A message popped up saying she had no active accounts and couldn't make the payment.

Wilson later learned what had happened. Without her knowledge, the bank had put her into a program that suspended payments on her federally backed loan. Known as forbearance, it is a CARES Act program that aims to help borrowers who are having trouble making their payments because they've been hurt by COVID-19.

Because she hadn't asked for forbearance, Wilson continued to make all her family's mortgage payments. She has also spent hours on the phone with Wells Fargo to get out of the program. Finally, on July 1, the bank sent her a letter confirming her request to "opt out" of the program she said she never opted into.

Still, Wilson's credit report, dated July 18 and reviewed by NBC News, shows that the family mortgage is "in forbearance" and that the April and May payments weren't credited to the account, even though the Wilsons submitted them.

While in forbearance, Wilson and her husband almost certainly can't refinance their mortgage, because most banks won't underwrite new loans for borrowers whose mortgage payments are suspended. As long as the forbearance notation remains in their credit report, the Wilsons can't take advantage of rock-bottom interest rates and are stuck at Wells Fargo.

"I click this button and next thing I know, I'm getting a thing that says I'm deferred and I can't reverse something I didn't even want," Wilson said in an interview. "If you're going to help people, there is a super simple first step — just ask, 'Do you need our help?'"

Under the CARES Act, which provides help on loans backed by the government-sponsored companies Fannie Mae, Freddie Mac, Ginnie Mae and others, borrowers harmed by COVID-19 can ask to suspend their mortgage payments for up to a year. The amounts they owe during the period are either tacked onto the ends of the loans or paid off before. No additional fees, interest or penalties can accrue on the loans while they are in forbearance.

Last week, NBC News reported on borrowers in Chapter 13 bankruptcy whom Wells Fargo had placed, without their permission, in forbearance programs. But the bank's practice extends beyond such specialized borrowers, some of whom contacted NBC News.

Wells Fargo is one of the largest U.S. banks that underwrites and services home loans. Borrowers in at least 14 states have told courts, lawyers or NBC News that they have been forced into forbearance plans by Wells Fargo: Alabama, Arizona, California, Florida, Kansas, Louisiana, Michigan, Missouri, New Hampshire, New Jersey, New York, North Carolina, Texas and Virginia.

"In the spirit of providing assistance, we may have misinterpreted customers' intentions in a small number of cases," Mary Eshet, a spokeswoman for Wells Fargo, said in a statement to NBC News. "In those limited cases, we are working directly with customers to ensure they are receiving the assistance they need and make any corrections to their accounts that may be required."

If you take the time to waive the paper statement fees by switching to online statements, Wells Fargo's monthly fees are slightly better than those at other major banks. However, the real advantage at this bank comes with the large variety of options. For instance, neither Chase nor Bank of America —Wells Fargo's two closest competitors —carry any options specifically marketed to customers whose credit or banking histories prevent them from getting approved for accounts elsewhere. The Wells Fargo Opportunity Checking Account gives such "toxic" bank customers an opportunity to get back into the mainstream banking system.

Wells Fargo Teen Checking is another account with excellent features. Designed for teenagers from 13 to 17 years old, it's one of the easiest accounts to maintain for free: the $3 monthly statement fee can be waived by simply switching over to online statements. Other banks usually impose minimum balance or activity requirements, which can be somewhat difficult for teens to fulfill. Besides being essentially free, the account provides access to money management tools you won't find at banks like Chase or Bank of America.

As for Wells Fargo's standard and premium checking accounts, you won't find much to differentiate the options from similar products at most other brick-and-mortar banks. Better checking options can be found online, if you're willing to live without access to a physical bank. Perhaps the most obvious benefit of Wells Fargo checking lies in how easy it is to find a branch office or ATM almost anywhere in the country. Interestingly, Wells Fargo is the only one of the three largest banks to operate branches in Alaska.

The interest rates at Wells Fargo aren't anything special, but if you're already taking out a loan or using a Wells Fargo checking account, it won't hurt to have a savings account there as well. With the more basic Way2Save Savings Account and Opportunity Savings, either a $300 daily balance or a $25 automatic transfer from your Wells Fargo checking account will waive the $5 maintenance fee. The real cost of keeping your savings with Wells Fargo is that you'll miss out on stronger rates elsewhere.

Wells Fargo vs. Chase

The retail banking division of JPMorgan Chase rounds out the list of top three U.S. banks, alongside Wells Fargo and Bank of America. Chase Bank branch locations tend to be concentrated in the country's most populated metropolitan areas, which means that Wells Fargo provides superior coverage in most other regions.

Location aside, Chase tends to fall behind Wells Fargo in the variety of checking and savings services it offers. It has no option for second-chance checking like Wells Fargo Opportunity Checking®, and while Chase's online banking interface is simple and intuitive, it doesn't provide any ways to assist in financial management like Wells Fargo's My Savings Plan and Budget Watch features do.

However, Chase does have a better set of credit card options, all of which earn points within the Ultimate Rewards program. This means that frequent credit card users may find better value banking with Chase, since they'll be able to link their bank balances to pay off Chase cards automatically.

Wells Fargo vs. Bank of America

Bank of America has a great deal of overlap with Wells Fargo in the states and cities they cover, but most people looking for a checking account will find a better deal at Wells Fargo. While Bank of America has higher daily debit and ATM withdrawal limits, most people shouldn't have a big problem with the limits set by Wells Fargo: you can withdraw up to $300 in cash from ATMs and spend up to $1,500 with your debit card each day.

Bank of America charges slightly more than Wells Fargo in monthly maintenance for its Core Checking Account, and it also charges a $5 paper statement fee that can only be avoided by choosing electronic statements. Wells Fargo charges $1 for the same service, and its monthly maintenance can be waived without any balance or direct deposit requirements: all you need is 10 debit card purchases each month.

Wells Fargo vs. Capital One

Capital One has a limited number of physical branch offices, but its strongest deposit account comes in the form of Capital One 360 Checking, an interest-bearing checking account serviced through the bank's online portal, earning 0.1% APY on any balance. Capital One also has a 360 Performance Savings Account that boasts a 0.4% APY. These rates are far higher than what you can earn with any Wells Fargo product, at any balance. If you're willing to give up banking in person, Capital One's bank accounts may present better value than Wells Fargo.

Like Wells Fargo, Capital One places a good deal of focus on small business accounts. The Capital One Spark Business Basic Checking and Spark Unlimited Checking Accounts come with unlimited free transactions, meaning businesses won't have to deal with a per-item fee every time their customers make a payment into the account. Most banks, including Wells Fargo, limit a business's free transactions to about 500 per month or fewer.

Bank of America vs. Citibank

Most consumers in the U.S. will want to select Wells Fargo over Citibank, simply because Wells Fargo operates far more domestic offices than Citibank. However, people who do end up spending a lot of time in other countries may find Citibank's global network of branches more useful. In terms of accounts, Citibank does provide higher daily spending and withdrawal limits than Wells Fargo, and makes it easier to waive the monthly fees.

In the end, though, a good checking account should let you access your money quickly and easily. Wells Fargo's ATMs and banks are much easier to reach than Citibank's, and the differences in fees and limits don't make up for Citibank's disadvantages in accessibility.

If you've never had to download your bank transactions from your bank before, it can be daunting and difficult however, we're here to offer a little bit of guidance.

You need to use your Online Banking from a web browser, not your mobile app.

Have a look for your bank below and follow the instructions. Alternatively, you can search Google for instructions on how to download your transactions as a PDF file or, visit your bank branch for a printed copy.

  • On the subheading bar above the list of your transactions you will be able to see ‘download all pdf’ which is on the right hand side, select that

  • Log in to Digital Banking
  • Once you’re logged in, select ‘statements’ from the options on the left of the screen.
  • Click on ‘view statement PDFs and certificates of interest’
  • Choose an account from the list
  • Choose a time period to view
  • Your full statement from that period will be displayed.
  • To download it as a PDF, simply click on the ‘Download statement (PDF)’ link at the top left
