Sprint Imposes $5 Monthly Fee Because You Might Pay Late

If you have a spending limit on your Sprint account because of your credit history, or in order to prevent runaway data bills, as of today you’ll have to pay for that privilege. Sprint has imposed a $4.99 per month surcharge on all mobile phone accounts that have spending limits in place.

An Account Spending Limit (ASL) can be initiated by the user, or imposed by Sprint on customers with a shaky credit history or past late payments. Reader Brittney writes that she had a limit put on her account voluntarily, and she’s angry about the fee.

Sprint is now charging people $5.00 a month just to have an ASL (Account Spending Limit). I received a letter in the mail regarding the change (let me also note that the letter is dated for the 21st of December and I just got it today [January 9th]) and it takes effect tomorrow [January 10th].

I can see how Sprint might be trying to shake off some of it’s more problematic customers with this move, but to me, this is completely ridiculous. I spent an hour on the phone with customer service asking to have this $5.00 fee waived, considering that I always pay my bill on time and requested the ASL be applied to my account in the first place. I was basically given two options; enroll in automatic payments or try and get ASL removed from your account.

Whaaaaa? I asked for ASL to be on my account when I signed up so if my phone was ever stolen or went missing, I wouldn’t find it later along with a bill for $500 (or more) worth of charges from someone calling another country. And as someone who is self-employed with a sporadic paycheck, I would prefer to not have a hard-to-remove-or-stop automatic payment on my account every month.

It’s obvious Sprint is targeting low-income people here with this move, as they will more than likely have no choice but to pay this fee. If you’re low-income, chances are you might not have much credit built up, making it hard for you to get the ASL waived in the first place since it is based on your credit history. I can also see how not having a bank account could really make this impossible for someone as well, since setting up an automatic payment would be impossible without one. I am low-income myself, but I keep my finances in tight order, have credit, and always pay Sprint on time. I guess that means I should pay an extra 5 bucks a month for the privilege of keeping an ASL on my phone line.

Brittney is right that this fee is an extra burden on Sprint customers who don’t have bank accounts and can’t set up automatic payments–and that group includes more Americans than you might think. Sprint may be using this fee as a penalty to get people who (statistically speaking) are less likely to pay on time to sign up for autopay, but is it fair?

CFPB Sues Sprint for Cramming Consumers with Unauthorized Third-Party Charges

Sprint Ignored Complaints from Consumers and Cost Them Tens of Millions of Dollars

WASHINGTON, D.C. — Today, the Consumer Financial Protection Bureau filed a lawsuit against Sprint Corporation for illegally billing wireless consumers tens of millions of dollars in unauthorized third-party charges. The Bureau’s complaint alleges that Sprint operated a billing system that allowed third parties to “cram” unauthorized charges on customers’ mobile-phone accounts and ignored complaints about the charges. The CFPB seeks refunds for affected consumers and penalties to deter unauthorized third-party charges in the future.

“Today we are suing Sprint for allowing illegal charges to be crammed onto consumers’ wireless bills,” said CFPB Director Richard Cordray. “Consumers ended up paying tens of millions of dollars in unauthorized charges, even though many of them had no idea that third parties could even place charges on their bills. As the use of mobile payments grows, we will continue to hold wireless carriers accountable for illegal third-party billing.”

Consumers use mobile phones to purchase an array of digital products, such as apps, games, books, movies, and music. Wireless carriers collect and process payments for these purchases and control the networks connecting merchants and customers. From about 2004 through 2013, nearly all wireless third-party billing involved products called “premium text messages” or “premium short messaging services” (PSMS) because they were frequently delivered by text messages. Sprint outsourced payment processing for these digital purchases to vendors called “billing aggregators” without properly monitoring them.

The lack of oversight gave aggregators near unfettered access to consumers’ wireless accounts. Sprint’s system attracted and enabled unscrupulous merchants who, in some cases, only needed consumers’ phone numbers to cram illegitimate charges onto wireless bills. The charges ranged from one-time fees of about $0.99 – $4.99 to monthly subscriptions that cost about $9.99 a month. Sprint received a 30-40 percent cut of the gross revenue from these charges.

Most consumers were targeted online. Consumers clicked on ads that brought them to websites asking them to enter their cellphone numbers. Some merchants tricked consumers into providing their cellphone numbers to receive “free” digital content and then charged for it. Many others simply placed fabricated charges on bills without delivering any goods or communicating with consumers.

The Bureau is alleging that Sprint, as a payment processor for third parties, violated the Dodd-Frank Wall Street Reform and Consumer Protection Act’s prohibition on unfair practices by:

  • Allowing third-parties to illegally charge consumers: Sprint’s billing system made it easy for third-party scammers to attach charges to consumers’ bills. Sprint profited from these illegitimate charges, while millions of consumers were victimized by them.
  • Automatically billing consumers for illegitimate charges without their consent: Sprint did not let customers opt in to third-party billing. Instead, the company automatically enrolled customers without their consent. This policy helped perpetuate the wrongdoing because many customers did not spot unauthorized charges, as they were unaware that third parties could place charges on their bills.
  • Disregarding red flags about third parties: Sprint disregarded red flags showing that its system was a breeding ground for unauthorized charges. Sprint continued to outsource to billing aggregators despite lawsuits about cramming against the very same aggregators that Sprint used. In addition, Sprint should have known that cramming was a major problem as the company had already been subject to a law enforcement action related to the issue.
  • Ignoring consumer complaints about unauthorized charges: Sprint failed to track customer complaints about unauthorized charges, and as a result, lacked the most basic alert mechanism that could have revealed flaws in its monitoring systems. Sprint also failed to provide full and prompt remediation to consumers subjected to these charges. In some instances, Sprint refused to provide refunds and only offered instructions on how to block future third-party charges. Other times, Sprint refused to provide refunds and referred customers to the merchants.

As a result, Sprint’s wireless customers – many of whom did not know that third parties could place charges on their bills – incurred millions of dollars in illegitimate charges. Sprint, in contrast, profited handsomely from its system, collecting hundreds of millions of dollars in revenue, according to the Bureau’s complaint. Sprint terminated premium short messaging services billing in December 2013.

The CFPB worked in close coordination with the Federal Communications Commission and received valuable assistance from its Enforcement Bureau in this matter.

Don’t ignore them. You can do things on your terms, but ignoring the situation will not make them go away. Ignoring them sets you up for a possible lawsuit.

Know Your State’s Statute of Limitations. Each state has a statute of limitations on debt. Once your debt reaches a certain age, it is considered “zombie debt,” and you are no longer legally obligated to pay it. The age limit varies from state to state, but usually, it’s around 4-6 years.

Sprint moves mobile payments needle with carrier billing

On the heels of the Sprint mobile wallet launch, the carrier is increasing the options for its subscribers to pay for online digital goods via their wireless bill.

Sprint is partnering with Danal Co. Ltd.’s BilltoMobile, a provider of mobile payments for Web purchases, to power the direct mobile billing gateway service, which will let the carrier’s customers charge online purchases directly to their Sprint bill. Once implementation is complete in the coming months, merchants and payment resellers using BilltoMobile’s mobile payment service will be able to offer this payment option to Sprint customers. 

“The strategy is to enable a new market in the online transaction space by leveraging the Sprint monthly statement as a payment/billing option,” said Chris Bierbaum, general manager of mobile commerce at Sprint. “Enabling the monthly Sprint statement as a payment option brings added convenience to the online transaction process for our subscribers.

“Direct mobile billing through Danal/BilltoMobile simply provides customers with another option for purchasing online digital goods and services that is convenient and secure,” he said.

“Our Sprint mobile wallet product, in partnership with Cardinal Commerce, allows Sprint subscribers to buy goods and services discovered on the mobile device by charging the transaction to their preferred credit card stored in the Sprint mobile wallet.”

BilltoMobile enables mobile payments for digital goods and services on Web browsers. Its strategic investor and majority shareholder is Seoul, South Korea-based Danal Co. Ltd.

In the U.S., several of its merchant partners are gaming virtual-worlds companies such as Nexon, NHN and IMVU, which offer virtual goods.

Carrier billing on the rise
The agreement with Sprint extends BilltoMobile’s overall reach to more than 240 million wireless subscribers in the U.S. across multiple carriers, including Verizon Wireless and AT&T.

These customers will now have instant access to a direct mobile billing platform offering a payment option that BilltoMobile claims requires no registration, no set up, no application or downloads and no association with other financial instruments such as credit or bank cards.

Purchases are completed using a two-step authentication process, where consumers enter their mobile phone number and ZIP code.

Customers do not have to expose any sensitive account information while using the service.

Sprint Imposes $5 Monthly Fee Because You Might Pay Late

If you have a spending limit on your Sprint account because of your credit history, or in order to prevent runaway data bills, as of today you’ll have to pay for that privilege. Sprint has imposed how to pay your sprint bill on your phone $4.99 per month surcharge on all mobile phone accounts that have spending limits in place.

An Account Spending Limit (ASL) can be initiated by the user, or imposed by Sprint on customers with a shaky credit history or past late payments. Reader Brittney writes that she had a limit put on her account voluntarily, and she’s angry about the fee.

Sprint is now charging people $5.00 a month just to have an ASL (Account How to pay your sprint bill on your phone Limit). I received a letter in the mail regarding the change (let me also note that the letter is dated for the 21st of December and I just got it today [January 9th]) and it takes effect tomorrow [January 10th].

I can see how Sprint might be trying to shake off some of it’s more problematic customers with this move, but to me, this is completely ridiculous. I spent an hour on the phone with customer service asking to have this $5.00 fee waived, considering that I always pay my bill on time and requested the ASL be applied to my account in the first place. I was basically given two options; enroll in automatic payments or try and get ASL removed from your account.

Whaaaaa? I asked for ASL to be on my account when I signed up so if my phone was ever stolen or went missing, I wouldn’t find it later along with a bill for $500 (or more) worth of charges from someone calling another country. And as someone who is self-employed with a sporadic paycheck, I would prefer to not have a hard-to-remove-or-stop automatic payment on my account every month.

It’s obvious Sprint is targeting low-income people here with this move, as they will more than likely have no choice but to pay this fee. If you’re low-income, chances are you might not have much credit built up, making it hard for you to get the ASL waived in the first place since it is based on your credit history. I can also see how not having a bank account could really make this impossible for someone as well, since setting up an automatic payment would be impossible without one. I am low-income myself, but I keep my finances in tight order, have credit, and always pay Sprint on time. I guess that means I should pay an extra 5 bucks a month for the privilege of keeping an ASL on my phone line.

Brittney is right that this fee is an extra burden on Sprint customers who don’t have bank accounts and can’t set up automatic payments–and that group includes more Americans than you might think. Sprint may be using this fee as a penalty to get people who (statistically speaking) are less likely to pay on time to sign up for autopay, but is it fair?
