EXCLUSIVE: BofA says it wants out of unemployment benefits contract as EDD renews

SAN FRANCISCO (KGO) -- The Employment Development Department, already beset by turmoil, just renewed its troubled partnership with Bank of America, walmart money card official site move that infuriated many lawmakers and the bank itself.

Bank of America tells 7 On Your Side exclusively it wants to get out of the contract as soon as possible. It just shows no one wants any more of the torture of the past year, but the EDD had the sole option to renew this contract and it did, to the chagrin of lawmakers and the bank itself.

It means Bank of America will continue delivering unemployment benefits on EDD debit cards for up to two more years despite rampant fraud, frozen accounts and a class action lawsuit.

Plenty of state lawmakers and EDD cardholders are none too happy about it. They wanted changes in the contract or a different bank, but the EDD decided to renew the contract, without any changes, for up to two years. The EDD says it was the right move for now, but promises change in the future.

Steve Daly was shocked to find a thief had drained all $16,000 from his EDD debit card. Instead of reimbursing him, Bank of America froze his account.

"I found out about the hack when there was no money in my account," he said. "It was a nightmare. Nobody knew what was going on."

Annmarie Garvey realized someone ran up $14,000 on her EDD account even before she got her debit card in the mail. The bank restored her money only to take it all back out, then froze her account too.

"I'm the victim and I'm being treated like the criminal," she said.

They are among thousands of fraud victims who say Bank of America made it impossible to get their benefits restored.

State lawmakers blasted EDD for renewing the exclusive contract with Bank of America to provide EDD debit cards, despite the widespread turmoil and fraud.

But as it turns out, Bank of America is equally dismayed. Just today, the bank told 7 On Your Side it wants out of the contract, saying: "We have advised the state that we would like to exit this business as soon as possible."

The deal with EDD has brought plenty of grief to the bank as well. BofA claims it lost $200 million to criminals making phony claims of fraud on EDD debit cards, which they falsely obtained.

"Bank of America and EDD, unfortunately, left our constituents hanging at the worst possible time," said State Assemblymember David Chiu, D-San Francisco.

"What they have done is renewed a contract that has made Californians' life so miserable," said State Senator Jim Patterson, R-Fresno.

Now the bank is facing a class action lawsuit, which claims Bank of America failed to prevent fraud or even put security chips on debit cards, then automatically denied claims without investigation.

A judge ruled the bank likely broke federal law by rejecting claims and freezing accounts using only an automated fraud filter.

"This is a bureaucracy that has to face the music sooner or later," said Patterson.

Bank of America says it received 230,000 claims of debit card fraud from last October to March. It denied more than half the claims, but says anyone can ask for a new review.

The EDD says the contract renewal gives Bank of America the time it needs to manage millions of ongoing accounts. It's also working with the bank to add security chips to the cards for the first time.

The bank said today it will meet its obligations, even as it wants out of the business.

The contract still includes a major financial perk for both the bank and the EDD.

Under the agreement, they share transaction fees generated every time someone swipes an EDD debit card. Those revenues skyrocketed during the pandemic. The bank did not disclose its share of the earnings.

"We were all surprised to learn that it's Californians who have to pay Bank of America to access their money," said Chiu.

The Beginning by, Me.

When I finally received my I-Phone, it was time to try banking on line. I downloaded this app & began a totally new adventure. As time provides, I’ve been slowly delving into what I thought would be an amazing experience where banking and bill pay would become easily completed with minimal effort. Wrong, not entirely true. At this point I am frustrated. To simply pay my bills every month, without fumbles, less stress and time, I find out from ALL options, I’m not able to do online banking to pay aforementioned bills because I don’t have the necessary accounts available to do so. I have checking, savings and a fairly healthy CD.I wonder, why can’t I bank online? Why does it say I’m unable to use this app for online banking because I haven’t the accounts to do so? Huh? What? I’m so confused! I can’t locate the forms I need either.I want to be sure when I pass, my daughter receives all my monies from these “Appropriately Established” accounts! I’ve called 3 times to have the forms mailed to me.to no avail and I’m unable to pay my bills online. I’m disabled, hooked up to oxygen, unable to go into the bank as I mentioned when I called. I was told to open online banking that that would help me handle everything from home. If I figure it out one day, you’ll receive the 5th star. Take care my friend.

New ‘Bill Pay’ is Horrible

The new Bill Pay section is poorly designed trash that has ruined the app experience. Not only is it ugly, it does a poor job of visually integrating with the rest of the app. Clunky and unintuitive, to now make an online payment you must sift through multiple screens, making multiple clicks—all of which is very confusing to the consumer. You now also have to manually assign a “pay by” date to complete the process which is terribly annoying. (The default should be set similar to the pre-updated version that automatically sets the earliest possible date for you. But, still allow a user to manually set their own “pay by” date if needed.) Overall, the former Bill Pay was MUCH easier to utilize and MUCH nicer to look at.

To add to the problems, we no longer have the ability to delete old “Pay To” accounts from within the app the way we could previously. Another oversight.

BOA has definitely taken steps backwards with this update. If I had to guess, budget cuts forced BOA to begin implementing new app updates via internal junior-level design team, rather than outsourcing to a professional UI/UX firm. As a result, this update has a “beta” feel displaying poor form, function and usability. Really embarrassing for a big bank.

Auto payment

Your auto payment feature is unacceptable. For some accounts you do not allow payment of statement balance or minimum payment amount which makes it impossible to automatically pay each month to avoid a late payment. You actually require a dollar amount and that can result in an overpayment which we then have to request to be refunded. That did happen to me. So I shut it off and as a result I was charged a late payment for being a few days late paying because I could not access my account to peoples online banking an unexpected charge that went through the account. Which leads to my next complaint about the website.

I could not remember my password and therefore could not get a reset as I did not have my credit card available. Instead of allowing reset like other credit card companies by answering chosen questions, you make us enter the account number which I did not have because I could not access my statements which are delivered online. Since I did not have my card with me, I had to call in. having to try to call back multiple times as your lines are very busy. By the time I was able to get a person on the phone, I was 3 or 4 days late paying and you had charged me a late payment. I always pay on time. You have years of history with me paying on time, yet your customer service refused to refund the charge even though I have years of history paying on time and only was late because I could not get into the account.

Fraudulent Unemployment Insurance Activity

Report Fraud

With the record number of unemployment insurance claims filed during the COVID-19 pandemic, Maryland, and states across the entire country, have seen an increase in activity by bad actors and fraudsters using illegally obtained data to file fraudulent unemployment insurance claims. Please note that there has been NO breach in our BEACON unemployment system.

If you believe that your information has been used to fraudulently file an unemployment insurance claim, please contact the Division of Unemployment Insurance’s Benefit Payment Control Unit by completing a “Request for Investigation of Unemployment Insurance Fraud” form and e-mailing it to [email protected]

If you received a 1099-G tax form, but did not apply for unemployment insurance benefits in Maryland in 2020, then please complete this Affidavit form and submit it along with picture ID to the Benefit Payment Control Unit by e-mailing [email protected]

If you are an employer and believe a fraudulent claim has been charged to your account, please file a benefit charge protest through your employer portal.

If you believe fraudulent transactions have been made on your Bank of America Debit Card, please contact the Debit Card Customer Service Center at 1-855-847-2029 to file a report and request a replacement card.

Avoid Scams

We have been alerted to a number of potential scam operations that are attempting to prey on unemployment insurance claimants. To help you distinguish between legitimate assistance from Maryland Division of Unemployment Insurance (DUI) staff and fraudulent assistance from a potential scammer, please remember the following:

  • DUI will never request or require payment for assistance with unemployment insurance, especially not through apps like Venmo or Cashapp.
  • DUI staff will not provide assistance to claimants through direct message on social media platforms like Facebook, Twitter, or LinkedIn.
  • DUI will never arrange for an adjudication or fact-finding interview over any teleconferencing platform, such as Zoom, BlueJeans, Google Hangout Meets, or Skype.
  • DUI does not provide assistance through text message and will not send any links asking a claimant to verify their account through text.
  • DUI will never ask for your bank account number, debit card number, or edd bank of america customer service phone number card number over e-mail or on social media
  • DUI will never request your BEACON password over e-mail.
  • All e-mails from legitimate DUI staff will come from a @maryland.gov e-mail address.

Avoid Scams on Social Media

Please be aware of pages and scammers on social media pretending to be the Maryland Department of Labor. Scammers are replicating the Maryland Department of Labor’s social media pages, directly messaging claimants, and attempting to steal their identity by asking for their personal information. These pages are particularly targeting members of unemployment groups on Facebook.

Fraudulent pages may look similar, but are newly created, do not have a lengthy history of posts, spelled differently (often with typos), and not verified with a blue check mark. “Maryland department of labour” is an example of a fraudulent page that looks similar, but is spelled differently. If you find a fraudulent page, please report it to the social media platform immediately and DO NOT respond to their messages.

New Chip-Enabled Debit Cards

Starting July 25, you will receive a new chip-enabled debit card if you:

  • Are a new claimant receiving EDD benefits for the first time.
  • Have a card that is expiring soon.
  • Need a replacement card because your card is expired or has been lost, stolen, or damaged. Learn more about replacement and expired cards.

About the Debit Card

The EDD issues benefit payments for Disability Insurance, Paid Family Leave, and Unemployment Insurance claims using a visa debit card. This prepaid debit card is a fast, convenient, and secure way to get your benefit payments and is not subject to a credit check or monitoring by the EDD. With the debit card you can:

  • Get your money sooner.
  • Use it everywhere VISA is accepted (in stores, online, and by phone).
  • Withdraw cash at ATMs, banks, and stores with cash back options.
  • Transfer funds to the financial institution of your choice at no additional cost.
  • Be notified when a deposit is made to your card or when you have a low balance.
  • Receive fraud protection from a Zero Liability Policy.

Note: Your card is valid for three years from the date it is issued and is used for all EDD benefit programs, so you should keep it until it expires.

New Cardholders

If you have never had a debit card from the EDD before, Bank of America will mail you a card after your first benefit payment has been issued by the EDD. It can take 7 to 10 business days to receive your card in the mail.

To activate a new card, use one of the following methods:

  • Online - Visit the Bank of America debit card website and select Activate My Card.
  • By phone - If you are calling from within the United States, call 1-866-692-9374 or 1-866-656-5913 (TTY). If you are calling from outside of the United States, call collect at 1-423-262-1650.

Existing Cardholders

Your card is valid for three years from the date it is issued and is used for all EDD benefit programs. If you previously participated in an EDD benefit program using a card, and began participating in an EDD benefit program again within three years of the date the card was issued, you will not have to wait for a new card to receive benefits. We will continue to load funds on your existing card and you will have immediate access to them.

Replacement and Expired Cards

If your card is lost or stolen, you must call Bank of America at 1-866-692-9374 (TTY: 1-866-656-5913). When prompted, choose the “lost or stolen” option from the automated menu. You do not need to have your old card number or speak to a representative.

If your card is damaged, you can order a replacement card online by visiting the Bank of America debit card website.

Replacement cards will be delivered in 7 to 10 business days from the date you order it. Once you order a replacement card, avoid requesting a second one. Ordering a second card will permanently block the first one and this may quality inn bangor airport a delay in receiving your payments.

Note: Bank of America representatives cannot answer questions about your claim or pending payments.

Expired Cards

Card Activity within the Last 90 Days or $20 or Greater Balance

If you have activity on your card within the last 90 days, or if there is a balance of $20 or more, Bank of America will automatically mail you a new card before your card expires.

No Card Activity within the Last 90 Days and Balance Less Than $20

If you did not have any activity on the card within the last 90 days, or if you have a balance of less than $20, contact Bank of America debit card customer service to request a new card. You can check your remaining balance by calling one of the telephone numbers listed in the Additional Information section of this page.

Returned Cards

If you no longer want to use your card, contact Bank of America to retrieve any remaining funds, and then destroy your card. Do not mail your card to the EDD for any reason. The EDD cannot accept returned debit cards and cannot remove funds from the debit card. If you return a card to the EDD, we will forward it to Bank of America for destruction.  If you have an overpayment established on your claim and would like to make a payment to the EDD, visit Benefit Overpayment Services to learn how.

Payments

It takes at least three weeks to process a claim for unemployment benefits and issue payment to most eligible workers. Payment information for Unemployment Insurance is updated daily and is available through your UI Online account or by calling the UI Self-Service Phone Line at 1-866-333-4606.

Payment information for Disability Insurance or Paid Family Leave can be accessed through your SDI Online account or by calling one of the toll-free numbers provided at Contact Disability Insurance and Paid Family Leave.

Emergency Cash Assistance

Bank of America can assist you with a domestic emergency cash transfer if you need cash from your debit card immediately, such as if your card is lost or you are still waiting for your card to arrive in the mail. You can speak with a Bank of America customer representative by calling one of the phone numbers listed in the Additional Information section of this page. Visit Bank of America’s website and select Fee Information for information about emergency cash transfer fees.

Track Your Payments

Keep track of your debit card payments and balance information by downloading the Bank of America Prepaid Card app from any app store. Payment information is updated daily and is available through your UI Online or SDI Online account or by calling one of the toll-free numbers provided on Contact EDD.

Disclosures and Fees

You will receive a welcome packet with your card. Be sure to read all information including fees for the debit card. For digital wallets, view the Digital Account Fees and Disclosures (PDF). Careful use of this card will help you avoid unnecessary fees.

Bank of America Sued for Failing to Protect the Accounts of Thousands of Unemployed Californians

A major lawsuit was filed today in the U.S. District Court in San Francisco, alleging that Bank of America failed to protect the unemployment benefits of thousands of Californians. The Complaint, filed by the law firm of Cotchett, Pitre & McCarthy, alleges that under its exclusive contract with the California Employment Development Department (EDD), Bank of America was required to provide secure accounts for unemployment payments; but failed to edd bank of america customer service phone number basic security measures, such as industry-standard chip technology to safeguard EDD debit cards. As a result, thousands have lost their only lifeline due to fraudulent transactions and hacked accounts.

The Complaint further alleges that, despite its “Zero Liability” policy, Bank of America has failed to respond in a timely way to thousands of defrauded customers. The bank’s ineffectual response to rampant fraud takes various forms, including not answering the customer service phone lines it advises EDD debit cardholders to call to report fraud, opening claims and then immediately closing them, failing to extend provisional credit to EDD cardholders, and the worst being freezing EDD cardholder accounts without warning or explanation.

The named plaintiff described her experience, which was typical of many:

"My account was emptied by unauthorized transactions on my Bank of America EDD debit card. When I tried to report the fraud to the bank, I was repeatedly disconnected, told to call back later, transferred to various departments to no end."

To date, like so many out-of-work Californians, she never been reimbursed for any of the unauthorized transactions on her EDD debit card, despite Bank of America’s “No Liability” policy.

According to Brian Danitz, a partner at Cotchett, Pitre & McCarthy, representing the many defrauded Californians:

"Bank of America failed to safeguard the accounts of EDD debit cardholders and then failed to handle fraud claims when made. The volume of unauthorized transactions was completely foreseeable given the lack of basic security measures. Hundreds of millions in California unemployment benefits have already been lost to fraud. Bank of America’s failure to help these fraud victims in a timely way is unconscionable and must be addressed."

Andrew Kirtley of Cotchett, Pitre & McCarthy, stated:

"It’s no secret that this pandemic has been economically devastating for millions of Californians. For many, EDD unemployment benefits are a matter of survival. EDD benefits recipients may not be Bank of America’s most lucrative customers, but they are among its most important. This lawsuit is a wake-up call for Bank of America."

Noorjahan Rahman of Cotchett, Pitre & McCarthy, put it bluntly:

"When a big corporation like Bank of America contracts with the State to administer unemployment benefits, it’s not just providing a service, it’s taking on a solemn duty to protect some of the most vulnerable in society. As alleged, Bank of America has utterly failed to uphold that duty."

The Complaint alleges that by failing to safeguard these state benefits from fraud and failing to address claims in a timely manner, Bank of America violated the California Consumer Privacy Act, California’s Unfair Competition Law, and Regulation E of the federal Electronic Funds Transfer Act; breached its contract with EDD cardholders; failed to warn EDD cardholders about the risks associated with its EDD debit cards; and negligently performed its contract with the California EDD, among other violations of law.

The lawsuit is Yick v. Bank of America, Case No. 3:21-cv-00376, in the U.S. District Court for the Northern District of California.

The Beginning by, Me.

When I finally received my I-Phone, it was time to try banking on line. I downloaded this app & began a totally new adventure. As time provides, I’ve been slowly delving into what I thought would be an amazing experience where banking and bill pay would become easily completed with minimal effort. Wrong, not entirely true. At this point I am frustrated. To simply pay my bills every month, without fumbles, less stress and time, I find out from ALL options, I’m not able to do online banking to pay aforementioned bills because I don’t have the necessary accounts available to do so. I have checking, savings and a fairly healthy CD.....I wonder, why can’t I bank online? Why does it say I’m unable to use this app for online banking because I haven’t the accounts to do so? Huh? What? I’m so confused! I can’t locate the forms I need either....I want to be sure when I pass, my daughter receives all my monies from these “Appropriately Established” accounts! I’ve called 3 times to have the forms mailed to me...to no avail and I’m unable to pay my bills online. I’m disabled, hooked up to oxygen, unable to go into the bank as I mentioned when I called. I was told to open online banking that that would help me handle everything from home. If I figure it out one day, you’ll receive the 5th star. Take care my friend.

New ‘Bill Pay’ is Horrible

The new Bill Pay section is poorly designed trash that has ruined the app experience. Not only is it ugly, it does a poor job of visually integrating with the rest of the app. Clunky and unintuitive, to now make an online payment you must sift through multiple screens, making multiple clicks—all of which is very confusing to the consumer. You now also have to manually assign a “pay by” date to complete the process which is terribly annoying. (The default should be set similar to the pre-updated version that automatically sets the earliest possible date for you. But, still allow a user to manually set their own “pay by” date if needed.) Overall, the former Bill Pay was MUCH easier to utilize and MUCH nicer to look at.

To add to the problems, we no longer have the ability to delete old “Pay To” accounts from within the app the way we could previously. Another oversight.

BOA has definitely taken steps backwards with this update. If I had to guess, budget cuts forced BOA to begin implementing new app updates via internal junior-level design team, rather than outsourcing to a professional UI/UX firm. As a result, this update has a “beta” feel displaying poor form, function and usability. Really embarrassing for a big bank.

Auto payment

Your auto payment feature is unacceptable. For some accounts you do not allow payment of statement balance or minimum payment amount which makes it impossible to automatically pay each month to avoid a late payment. You actually require a dollar amount and that can result in an overpayment which we then have to request to be refunded. That did happen to me. So I shut it off and as a result I was charged a late payment for being a few days late paying because I could not access my account to pay an unexpected charge that went through the account. Which leads to my next complaint about the website.

I could not remember my password and therefore could not get a reset as I did not have my credit card available. Instead of allowing reset like other credit card companies by answering chosen questions, you make us enter the account number which I did not have because I could not access my statements which are delivered online. Since I did not have my card with me, I had to call in... having to try to call back multiple times as your lines are very busy. By the time I was able to get a person on the phone, I was 3 or 4 days late paying and you had charged me a late payment. I always pay on time. You have years of history with me paying on time, yet your customer service refused to refund the charge even though I have years of history paying on time and only was late because I could not get into the account.

EXCLUSIVE: BofA says it wants out of unemployment benefits contract as EDD renews

SAN FRANCISCO (KGO) -- The Employment Development Department, already beset by turmoil, just renewed its troubled partnership with Bank of America, a move that infuriated many lawmakers and the bank itself.

Bank of America tells 7 On Your Side exclusively it wants to get out of the contract as soon as possible. It just shows no one wants any more of the torture of the past year, but the EDD had the sole option to renew this contract and it did, to the chagrin of lawmakers and the bank itself.

It means Bank of America will continue delivering unemployment benefits on EDD debit cards for up to two more years despite rampant fraud, frozen accounts and a class action lawsuit.

Plenty of state lawmakers and EDD cardholders are none too happy about it. They wanted changes in the contract or a different bank, but the EDD decided to renew the contract, without any changes, for up to two years. The EDD says it was the right move for now, but promises change in the future.

Steve Daly was shocked to find a thief had drained all $16,000 from his EDD debit card. Instead of reimbursing him, Bank of America froze his account.

"I found out about the hack when there was no money in my account," he said. "It was a nightmare. Nobody knew what was going on."

Annmarie Garvey realized someone ran up $14,000 on her EDD account even before she got her debit card in the mail. The bank restored her money only to take it all back out, then froze her account too.

"I'm the victim and I'm being treated like the criminal," she said.

They are among thousands of fraud victims who say Bank of America made it impossible to get their benefits restored.

State lawmakers blasted EDD for renewing the exclusive contract with Bank of America to provide EDD debit cards, despite the widespread turmoil and fraud.

But as it turns out, Bank of America is equally dismayed. Just today, the bank told 7 On Your Side it wants out of the contract, saying: "We have advised the state that we would like to exit this business as soon as possible."

The deal with EDD has brought plenty of grief to the bank as well. BofA claims it lost $200 million to criminals making phony claims of fraud on EDD debit cards, which they falsely obtained.

"Bank of America and EDD, unfortunately, left our constituents hanging at the worst possible time," said State Assemblymember David Chiu, D-San Francisco.

"What they have done is renewed a contract that has made Californians' life so miserable," said State Senator Jim Patterson, R-Fresno.

Now the bank is facing a class action lawsuit, which claims Bank of America failed to prevent fraud or even put security chips on debit cards, then automatically denied claims without investigation.

A judge ruled the bank likely broke federal law by rejecting claims and freezing accounts using only an automated fraud filter.

"This is a bureaucracy that has to face the music sooner or later," said Patterson.

Bank of America says it received 230,000 claims of debit card fraud from last October to March. It denied more than half the claims, but says anyone can ask for a new review.

The EDD says the contract renewal gives Bank of America the time it needs to manage millions of ongoing accounts. It's also working with the bank to add security chips to the cards for the first time.

The bank said today it will meet its obligations, even as it wants out of the business.

The contract still includes a major financial perk for both the bank and the EDD.

Under the agreement, they share transaction fees generated every time someone swipes an EDD debit card. Those revenues skyrocketed during the pandemic. The EDD raked in more than $47 million from last March until this April, nearly five times more than in 2019.

The bank did not disclose its share of the earnings.

"We were all surprised to learn that it's Californians who have to pay Bank of America to access their money," said Chiu.

"A split of state money fees collected with your contractor, that just smells," Patterson said.

We've found many cardholders so frustrated they are now having the EDD mail paper checks instead.

The EDD says it's also planning to offer an option for direct deposit of benefits into personal bank accounts, avoiding debit cards entirely.

A new federal lawsuit takes aim at Bank of America for failing to secure the unemployment debit cards of thousands of Californians, part of a chaotic response to record jobless claims that has made the state Employment Development Department the target of widespread fraud.

The complaint filed Jan. 15 in U.S. District Court in San Francisco alleges that the bank acted negligently and proved “either unwilling or unable to stop criminals” from breaching unemployment debit card accounts. In the process, thousands of out-of-work Californians were left unable to access badly needed unemployment funds, or in some cases penalized for alleged fraudulent charges.

“This case is pretty unique,” Brian Danitz, a Bay Area partner at plaintiff law firm Cotchett, Pitre & McCarthy, told CalMatters. “This is a $286 billion financial Goliath. The CEO makes $25 million a year, and they did not provide even basic security measures to protect EDD cardholders.”

As CalMatters exclusively reported, confusion over mass unemployment fraud during the pandemic has led to finger pointing between the state and Bank of America, which has been contracted since 2010 to electronically pay out unemployment benefits. The lawsuit was filed as a class action case, pending court review, and Danitz said his office has been “flooded with other victims” since filing the suit.

Among the issues raised in the 67-page complaint are the lack of secure microchips in unemployment debit cards, a “failure to secure” private account information and a sluggish response to consumer fraud reports. The complaint cited reporting by CalMatters on the bank’s exclusive state contract, its promise to deliver the state “best-in-class” fraud monitoring and how the confusion over fraud has impacted jobless Californians.

On Feb. 3, a second class-action complaint was filed against Bank of America by an attorney who previously represented victims’ families after Oakland’s deadly 2016 Ghost Ship warehouse fire. The new suit against the bank, similar to the one filed in January, alleges that the debit card provider acted negligently and breached its contract by failing to prevent fraud on the accounts of unemployment claimants.

“The events of 2020 were hard enough without Bank of America making life even more difficult for California’s unemployed,” attorney Mary Alexander said in a statement. “These are hard-working people who were unable to pay rent, heat their homes or put food on the table due to Bank of America’s negligence.”

While some labor attorneys have raised the prospect of litigation against the Employment Development Department for its role in mass unemployment payment freezes, the complaints assert that Bank of America violated a “zero liability” clause in its exclusive state contract, which shields unemployment cardholders from having to pick up the tab for any fraud.

William Halldin, a spokesperson for Bank of America, told CalMatters that the bank is committed to returning funds to legitimate unemployment claimants and has increased relevant staffing more than twenty-fold during the pandemic, to some 6,150 workers nationwide. Though fraud investigations are ongoing in California and other states where Bank of America holds similar contracts, the bank contends that the “vast majority” of recent unemployment fraud in California is linked to state application vetting, rather than hijacked unemployment debit cards. 

“California’s unemployment program faces billions of dollars in fraud,” Halldin said. “Bank of America is working every day with the state to prevent criminals from getting money and ensuring legitimate recipients receive their benefits.”

The lawsuit filed in January revolves around the experience of San Francisco property manager Jennifer Yick, who felt like she was “sucker punched” when she discovered more than $400 had been drained from her Bank of America unemployment debit card, including large out-of-state DoorDash charges at a cake shop and a barbecue restaurant. Yick told CalMatters that she has never used the food delivery service, did not receive any fraud alerts and when she tried to report the suspected fraud in early December, she was repeatedly hung up on by Bank of America customer service. 

The money still hasn’t been refunded to her account, but Yick said she had a bigger motivation for filing suit on behalf of others in similar situations: “Am I a second-class citizen?” Yick said. “That’s how I felt.”

At the center of the controversy is California’s ongoing struggle to distinguish fraud from legitimate claims at a time when unemployment claims are going back up. The CEO of the identity-security firm ID.me told CalMatters that domestic and international fraud rings are targeting California because of its size and leniency in paying backdated claims, which can allow criminals to quickly accumulate thousands of dollars per fraudulent claim.

Still, fraud experts have warned that unraveling who is responsible for picking up the tab for large-scale criminal activity is likely to get complicated — and maybe even leave taxpayers on the hook.

“If it turns out that California should not have approved all these claims,” said Mason Wilder, a research specialist at the Association of Certified Fraud Examiners, “then regardless of what their agreement says with Bank of America about debit cards, I would think that ultimately the taxpayers are going to be on the hook for California’s errors.”

All told, the state has paid out $113 billion in unemployment benefits since March. The bank declined to comment on how many California unemployment claimants have filed debit card fraud complaints during that time.

What do I do if I my ATM Card is not working or has been lost or stolen? , open

If your card has been lost or stolen, contact us immediately by calling collect: 315.424.4022 from outside the U.S. or 800.432.1000 domestically (Mon–Fri 7 a.m.-10 p.m. or Sat–Sun 8 a.m.-5 p.m., excluding holidays; all times ET). You can also sign in to Online Banking and request a replacement card.

If your card is in your possession but is being declined or not working at an ATM, sign into Online or Mobile Banking and make sure you have sufficient funds or credit available to cover your transaction.

If your card is not working due to being blocked for suspicious or unusual activity, you may receive a text, email and/or notification when you sign into Online or Mobile Banking. Upon signing in you may be asked to verify recent activity to ensure your card information has not been compromised.

What should I do if I'm having trouble calling internationally? , open

Some countries may require that you enter an international access code or + from any mobile phone prior to entering a country code, area code and phone number. If you are outside the U.S. and are having trouble making an international call using 1, the area code and the phone number, we suggest adding the international access code first and trying your call again. (Example: Europe’s international access code is 00 or + from a mobile phone, so to make an international call to the U.S. from Europe when an access code is required you would dial 00, 1, area code, phone number.) You can find your country's international access code using most online search engines.
